Plain-English summary
- Checkify provides privacy-first verification tools so people can share limited proofs (such as age thresholds or human checks) with businesses.
- You must use Checkify honestly and lawfully. Businesses must choose appropriate checks and not overstate what a proof shows.
- Checkify is designed so Businesses receive proofs rather than unnecessary raw identity data. For standard on-device verification, raw document images, NFC chip contents and biometric templates are not transmitted to or retained on Checkify servers unless a feature clearly tells you otherwise before use. Operational metadata may still be processed.
- Some Services may be free for a limited promotional period (for example Free Age Verification credits). Partner or platform commercial arrangements may differ and are governed by separate written partner terms when they apply. Paid use may involve subscriptions, credits or additional usage, as shown when you buy or subscribe. A Fair Usage Policy applies to abuse and prohibited use.
- Nothing in these Terms removes rights that cannot lawfully be excluded.
This summary is not a substitute for the full Terms below.
1) About these Terms and Checkify
These Terms and Conditions (“Terms”) are issued by Checkify Technologies Ltd (“Checkify”, “we”, “us”, or “our”), the company operating the Checkify platform.
They apply to use of Checkify websites, mobile applications, APIs, SDKs, plugins, dashboards, Passes, Verification Requests, Proofs and related services (together, the “Services”) available at checkify.me.
In these Terms:
- “User” means an individual who uses Checkify to respond to a Verification Request, hold credentials or proofs on a device, or otherwise interact with the Services as an end user.
- “Business” or “Relying Party” means an organisation or person that uses Checkify to request, receive or act on Proofs or Verification Results.
- “Verification Request” means a request for a Proof or Verification Result created through the Services.
- “Proof” or “Verification Result” means the limited answer, claim, status or attestation returned for a Verification Request (for example that a person meets an age threshold), not a copy of underlying identity documents unless a feature expressly provides otherwise.
- “Checkify Pass” means a configured verification product or request profile used by a Business to start Verification Requests.
If you use the Services on behalf of a Business, you confirm that you have authority to bind that Business to these Terms.
2) Acceptance and eligibility
By accessing or using the Services, creating an account, installing a plugin or SDK, or completing a Verification Request, you agree to these Terms.
If you do not agree, you must not use the Services.
Additional product-specific terms, order forms, Partner Programme Agreements, Data Processing Agreements or acceptable-use rules may also apply. Where they conflict with these Terms for a defined subject matter, the more specific written document prevails for that subject matter.
You must be at least 16 years old to create a Checkify User account, or older if applicable law requires a higher minimum age. Where a Service is intended for a particular age group or use case (for example age-restricted access checks), additional eligibility rules may apply in the product flow. Parents or guardians remain responsible where they allow a minor to use a device that interacts with Checkify under applicable law.
3) What Checkify provides
Checkify provides privacy-first verification technology so Users can share limited Proofs with Businesses.
Depending on configuration, Services may include age-threshold proofs, human verification, business or site verification features, reusable credentials, wallet-style device credentials, integrations, dashboards, APIs and related tooling.
Feature availability depends on plan, region, configuration, device capability and product stage. Not every feature is available to every customer at all times.
4) Verification sources and methods
Depending on the Service, Verification Requests may use different methods and data sources. These may include device signals; identity documents; NFC-enabled documents; camera, selfie or liveness checks; third-party credential or wallet providers; trusted data issuers; business-provided information; external verification services; and other approved sources made available by Checkify from time to time.
The method used depends on the Pass, request type, assurance level, device capability and configuration selected by the Business or User flow.
5) Verification results are evidence, not guarantees
A Proof or Verification Result is evidence about a specific requested attribute or claim at the time it is produced. It is not an absolute guarantee of identity, future eligibility, honesty, legality, creditworthiness, safety, suitability or regulatory compliance.
Businesses remain responsible for deciding what level and type of verification is appropriate for their use case, risk appetite and legal obligations. Where Checkify provides a Proof, it does not make the Business’s final legal, commercial, access or eligibility decision unless a separate written agreement expressly says otherwise.
Do not treat a Checkify result as certifying a person for all purposes. For example, an age-threshold Proof such as “Over 18” must not be presented as proving a person’s full identity unless identity was separately verified and disclosed under the relevant request.
A Business’s initiation of or payment for a Verification Request does not give that Business ownership of the User’s identity, underlying identity information, device-held credentials, reusable proofs, wallet contents or credentials obtained from other issuers. The Business receives only the Proof, Verification Result or other information made available for that request.
Where supported by the relevant Service, a User may be able to reuse an existing credential or previously established evidence to respond to another Verification Request without repeating the original collection process. Reuse is not guaranteed for every Proof or feature. Each subsequent use may create a new Verification Request and result. A Business does not automatically gain access to the User’s previous interactions with other Businesses. Reuse remains subject to validity, expiry, configuration, device state and Checkify’s product rules.
A Proof may include or depend on information such as when it was established or verified, its assurance level, source, expiry, status or, where supported, revocation/status information. Different Businesses may require different levels of assurance or recency. A previously established Proof should not be assumed to remain suitable indefinitely. Businesses remain responsible for deciding whether a particular Proof is sufficiently recent and appropriate for their use case.
Payment and fraud context. Where a Verification Request or Proof is used in connection with a payment, checkout or fraud-reduction workflow — including flows that link a verified person to a payment method or transaction approval — that link is intended to reduce risk. It does not guarantee that a payment is legitimate, authorised, non-fraudulent or free from dispute, chargeback or misuse. Businesses remain responsible for their own payment, fraud and risk controls.
6) Business and relying-party responsibilities
If you use Checkify as a Business or Relying Party, you are responsible for:
- Selecting verification requirements — including the type of Proof and any required assurance or recency — that are appropriate and proportionate for your use case and jurisdiction.
- Complying with laws and regulations that apply to your activities, including age-restricted sales, consumer, privacy, anti-money-laundering, gambling and anti-discrimination rules where relevant.
- Configuring Checkify Passes, Verification Requests, integrations, websites and workflows correctly and securely.
- Using Verification Results only for legitimate purposes disclosed to Users where required.
- Avoiding requests for unnecessary information when a limited proof would meet your need.
- Providing any notices and obtaining any consents required for your use of Checkify.
- Protecting information received through Checkify and applying appropriate security, access and retention controls consistent with applicable law and the purpose for which it was obtained. Receipt of a Verification Result is not permission to retain it indefinitely where law or purpose no longer supports retention.
- Maintaining suitable fallback procedures if Checkify is unavailable, delayed or returns an unexpected result.
- Making your own final decisions about transactions, access, eligibility and compliance.
- Not misrepresenting what Checkify has verified. You must not present a result as proving something beyond the actual Proof returned.
Using Checkify does not automatically make your Business compliant with every law that applies to your activities. Checkify can provide verification technology and evidence designed for age-assurance and other verification workflows, but you remain responsible for selecting the required assurance level, implementing the integration correctly, enforcing the result, and satisfying the law applicable to your specific activity and jurisdiction.
Initiating or paying for a Verification Request does not transfer ownership of the User’s identity information, device-held credentials, reusable proofs, wallet contents or third-party credentials to your Business.
7) User responsibilities
If you are a User, you agree that you will:
- Provide accurate information where required for a verification or account function.
- Use the Services only for lawful purposes.
- Protect your account, device, PIN, biometric access and credentials.
- Not impersonate another person or use another person’s documents, credentials, device or account without lawful authority.
- Not bypass, manipulate or interfere with verification, device or security signals.
- Not submit fraudulent Verification Requests or attempt to obtain false Proofs.
- Not attack, disrupt or reverse engineer the Services except to the extent such activity is expressly permitted by applicable law (including lawful security research where that law prevents Checkify from prohibiting it).
- Not knowingly alter a Proof, falsify its source, alter its assurance level, expiry or status, replay a Proof outside its intended context where that is restricted, or represent one type of Proof as another.
8) User app, wallet and device credentials
Some Checkify features store or process credentials, proofs or verification evidence on the User’s device (sometimes described as a wallet or reusable credential). Device-held evidence is used to create limited Proofs for Businesses. That architecture is not the same as Checkify retaining raw identity documents on its servers.
You are responsible for protecting access to your device and Checkify app. If your device is lost, stolen, replaced or compromised, you should use available in-app controls to lock, revoke or re-establish credentials where supported, and contact support@checkify.me if you need help securing your account.
Where the product supports it, you may delete or revoke stored proofs or credentials, disconnect a device, or request account deletion. Account deletion and related retention are handled as described in the Privacy Policy and any in-product deletion flow. Deleting an account or device credentials may prevent reuse of previously established proofs. Businesses that already received a Proof for a completed Verification Request may retain that result only as permitted by law and their own purpose.
Checkify does not guarantee that every credential can be migrated automatically to a new device. Re-verification may be required after device change, app reinstall, key rotation or security events.
9) Privacy and data processing
How Checkify handles personal information is explained in our Privacy Policy. That policy forms part of how the Services operate and should be read with these Terms.
Checkify is designed around privacy and data minimisation. Verification is designed so that Businesses receive a limited Proof or Verification Result rather than unnecessary underlying identity information.
On-device evidence. For standard on-device verification flows, identity-document images, passport or identity-document NFC chip contents, MRZ strings used as chip access material, facial images and biometric templates used for matching or liveness are processed on the User’s device for the purpose of creating a Proof. Unless a specific feature clearly tells you otherwise before you use it, that underlying identity evidence is not transmitted to or retained on Checkify’s servers.
What Checkify may still process. Checkify may process operational information required to run the Services. This can include account information; request and reference identifiers; verification outcomes and proof metadata; security information; device or key identifiers; audit events; operational logs; fraud-prevention signals; billing records; information required by a particular verification feature that is disclosed before use; and information required for legal compliance or support.
These Terms do not mean that Checkify never processes or stores any information. Operational, security, audit and verification metadata may be processed or retained where necessary, as described in the Privacy Policy. Device-held processing of sensitive evidence is part of the privacy design; it is not a claim that no data exists anywhere in the system.
The respective data-protection roles of Checkify and a Business may depend on the Service and processing involved and may be further described in the Privacy Policy, a Data Processing Agreement or an applicable commercial agreement. These Terms do not state that Checkify is always a controller, processor or joint controller for every activity.
Where Checkify processes personal data on behalf of a Business as a processor, a Data Processing Agreement is available on request from privacy@checkify.me. Subprocessor and service-provider information is described in the Privacy Policy or related documentation.
10) Security
Checkify uses reasonable technical and organisational measures designed to protect the Services and information processed through them, including encryption in transit and appropriate access, integrity, monitoring and security controls. Further implementation detail may appear on the Security page.
References to encryption in transit do not mean that every Checkify data flow is end-to-end encrypted in all circumstances.
No system, transmission method or storage mechanism can be guaranteed to be completely secure. You must tell us promptly if you believe your account, device, key, verification, integration or related credentials have been compromised.
Security reports can be sent to security@checkify.me. More detail on our security approach is available on our Security page.
11) Third-party services and wallets
Some Services may depend on third parties, including identity or document services, data issuers, credential providers, wallets (including external wallets), government or education credentials, business credentials, trusted data providers, payment providers, hosting or infrastructure providers, platform integrations and other credential ecosystems made available by Checkify from time to time.
Those third parties may have their own terms and privacy policies. Checkify does not control every third-party service and does not guarantee the availability, accuracy or continued operation of independent third-party services beyond what Checkify can reasonably control.
Details of certain service providers and subprocessors may appear in the Privacy Policy or related documentation rather than in these Terms.
Where a Proof relies on information or a credential issued by a third party, Checkify may verify, validate, process or communicate that credential or a resulting Proof without being the original issuer of the underlying information. The issuer may remain responsible for the original assertion. Checkify remains responsible for Checkify’s own verification, processing and presentation of a Proof through the Services.
12) Data issuer obligations
Where you use Checkify as a data issuer, credential issuer or similar role, you must have lawful authority to issue the relevant credentials or assertions.
You are responsible for the accuracy, completeness and currency of information you issue; for keeping credentials updated; and for revoking, suspending or correcting credentials when they are wrong, expired, withdrawn or no longer should be relied upon, using the controls Checkify makes available or another agreed process.
Checkify is not responsible for false, outdated or unauthorised assertions originating from an issuer, except to the extent caused by Checkify’s own failure to operate issuer tooling in accordance with these Terms or a separate written agreement.
13) Integrations, plugins, APIs and SDKs
Checkify may make integrations, plugins, APIs and SDKs available from time to time, including for common website and commerce platforms and for custom applications. Not every integration is generally available in every market or plan.
Businesses and developers are responsible for correct installation and configuration; securing API credentials and secrets; their own code, websites and platforms; and keeping supported versions updated.
Checkify may change, limit or discontinue integration functionality where required by platform rules, API changes, security needs or product decisions. You should review release notes and documentation for supported versions.
14) Beta and experimental features
Checkify may designate certain functionality as beta, preview, experimental, pilot or early access. Designated beta or preview features may contain errors, may change materially, or may be withdrawn before general availability.
Production Services are not automatically unreliable merely because some functionality is designated beta. Beta and preview features should be evaluated for suitability before being relied upon for critical or regulated use cases and may be subject to additional limitations communicated with the feature.
Businesses remain responsible for fallback processes if a feature is unavailable, delayed or produces an unexpected result.
15) Fees, free offers, subscriptions and credits
Free Age Verification (promotional offer). Where Checkify offers Free Age Verification or launch promotional credits to new businesses through Checkify’s own signup flows, the commercial limits of that offer are stated upfront: up to 500 verification credits for 3 months from grant, whichever occurs first. No payment card is required to start. The offer ends when credits are used up or the 3-month period expires — whichever happens first. This is not an unlimited free service.
Partner-channel and other commercial arrangements. “Free” in partner, affiliate, reseller, platform or white-label sales materials may refer to a different commercial model (for example fees paid by a partner, bundled platform pricing, or a separate free period). Where a merchant is onboarded through an approved partner or under a written Partner Programme Agreement or other commercial arrangement, the fees, free periods, credits and who pays for usage are governed by that arrangement. Those terms may differ from the Free Age Verification promotional offer above. Unless the arrangement says otherwise, these Terms still govern use of the Services.
What “verification credits” means. Credits are service usage units used to measure successful checks or other billable activity. Age verification currently uses credits when a check completes successfully (human verification currently uses 0 credits). Credits are not currency, have no cash value, and cannot normally be redeemed for cash. Current credit costs and plan allowances are shown on the pricing page or in your account.
No card required to start (self-serve promotional offer). You can register and use Free Age Verification / launch promotional credits without adding a payment method. You will not be charged until you choose a paid plan, buy credits, or enable additional paid usage features, unless a separate commercial arrangement provides otherwise.
Fair Usage Policy is separate. Abuse, abnormal usage intended to circumvent limits, multiple-account gaming, prohibited use, and similar misconduct are governed by the Fair Usage Policy and Acceptable and prohibited use section below — not by treating the promotional credit/time limits as “fair use” alone.
Paid Services. Other Services may require subscriptions, verification credits, included allowances, additional or overflow usage charges, or other fees. Current commercial pricing is shown on the pricing page, in your account, or in an order or agreement that applies to you. These Terms do not hard-code list prices.
Billing may be handled through payment providers such as Stripe. Applicable taxes may be charged where required and as shown during payment or invoicing by Checkify or its payment provider. Checkify may change pricing, plans and credit rules from time to time; changes will be reflected on the pricing page, in your account or in the order process.
Credits may be subject to expiration, renewal or plan-specific rules. Unless stated otherwise for a particular plan or purchase: credits included with a subscription currently expire 30 days after they are granted; one-off credit packs do not currently expire; Free Age Verification / launch promotional credits expire at the earlier of credit exhaustion or 3 months from grant. If a purchase, account screen or written agreement states different rules for a specific product, those specific rules apply to that product.
Where you purchase a recurring subscription, charges may continue for successive billing periods until the subscription is cancelled in accordance with the cancellation options available for your account. One-off credit packs do not automatically renew as subscriptions. Businesses can typically manage and cancel subscriptions through the business account billing tools (including the Stripe customer billing portal where enabled). Where cancellation is configured to take effect at the end of the then-current billing period, you may retain access to the applicable paid Service until that period ends. Exact cancellation timing can depend on the payment-provider and account configuration in force.
Refunds. Checkify does not operate a general open-ended refund scheme for completed digital Services. Refunds, if any, are handled according to any terms shown for a specific purchase, any separate written agreement, the payment provider’s applicable process, and mandatory law (including consumer rights that cannot be excluded). These Terms do not create a general right to a refund beyond what is required by law or expressly offered for a purchase.
16) Partner, referral and reseller programmes
Checkify may operate partner, referral, affiliate, reseller, platform or white-label programmes. Participation, commission, revenue share, branding rights, and who holds the merchant customer relationship are governed by a separate Partner Programme Agreement or other written commercial terms when you join such a programme.
Unless that separate agreement says otherwise: (a) these Terms continue to apply to use of the Services by partners and by merchants they introduce; (b) Checkify and the merchant remain responsible for their own data-protection roles as described in the Privacy Policy or applicable DPA; and (c) partners must not misrepresent Checkify’s fees, privacy architecture or regulatory effect.
Detailed commercial terms such as commission rates, clawback rules, life-of-account payments or platform kickbacks are not set out in these Terms and appear only in the applicable Partner Programme Agreement or order form.
17) Intellectual property and licence
Checkify and its licensors retain all rights in the Services, including software, platform, APIs, SDKs, branding, documentation, designs, content and technology, except for open-source components distributed under their own licences.
Subject to these Terms, Checkify grants you a limited, non-exclusive, non-transferable right to access and use the Services for their intended purpose.
Checkify does not claim ownership of information that belongs to Users or Businesses merely because it is submitted through the Services. Checkify receives only the limited rights necessary to provide, operate, maintain and secure the Services, comply with applicable law, and otherwise process information as described in the Privacy Policy. These Terms do not grant Checkify a right to use identity documents, biometric information or verification data for unrelated AI or model-training purposes.
Unless you opt out by emailing support@checkify.me, Business customers grant Checkify a non-exclusive right to use the Business’s name and logo to identify them as a Checkify customer in websites, pitch materials and case studies. Checkify will not disclose confidential commercial terms without consent.
Except as allowed by applicable law or a separate written agreement, you must not:
- Copy, resell, sublicense or commercially redistribute the Services or proprietary Checkify materials outside permitted use.
- Reverse engineer or create derivative works from proprietary Checkify software except where the law expressly permits it.
- Remove proprietary notices from Checkify materials.
- Create misleading Checkify-branded services or use Checkify branding in a way that suggests endorsement or partnership without permission.
18) Acceptable and prohibited use
Fair Usage Policy
Checkify’s Fair Usage Policy covers abuse and misuse of the Services — including Free Age Verification and other promotional offers — such as attempts to circumvent credit or time limits, create multiple accounts to obtain repeated promotional grants, automate abusive verification volume, or otherwise use the Services in a manner inconsistent with normal business use.
Checkify may investigate suspected abuse, require additional verification, limit or reset promotional grants, refuse service, or suspend or terminate accounts that create multiple accounts, game limits, or otherwise breach this Fair Usage Policy.
The Fair Usage Policy does not replace the stated credit and time limits of a promotional offer; those commercial limits apply in addition to abuse controls.
You must not use the Services to:
- Violate applicable law or the rights of others.
- Commit fraud, identity theft or unauthorised access.
- Bypass age, access or verification controls.
- Harass, abuse or harm individuals.
- Distribute malware or interfere with Service integrity or availability.
- Misrepresent Checkify results or forge proofs.
- Use the Services in any way that creates unreasonable load or security risk.
19) Availability and changes to the Services
Checkify aims to keep the Services available and useful, but does not guarantee uninterrupted or error-free operation.
Checkify may modify, suspend or discontinue features where reasonably required for security, legal, operational or product reasons.
Where a change materially reduces a paid Service you rely on, Checkify will take reasonable steps to provide notice where practical.
20) Suspension and termination
Checkify may suspend or terminate access if you breach these Terms, create security or legal risk, fail to pay amounts due, or if required by law or a platform partner.
Where practical and appropriate, we may use proportionate suspension before permanent termination. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, liability limits that are lawful, indemnity, and governing law) continue after termination.
21) Disclaimers and regulated-sector scope
To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. Checkify does not warrant that the Services will be uninterrupted, error-free, completely secure, or suitable for every purpose.
Checkify provides verification technology. Unless explicitly contracted otherwise in writing, Checkify is not itself a law firm, regulator, compliance adviser, AML adviser or financial adviser.
Using Checkify does not automatically make a Business compliant with every law applying to its activities, including age-assurance or age-restricted sales laws. Checkify provides verification technology and evidence that can be used in those workflows; Businesses remain responsible for determining their legal obligations and whether their chosen Checkify configuration, enforcement and processes satisfy them.
Regulated sectors, including gambling and AML. A Checkify Proof confirms the specific attribute or claim requested for that Verification Request. It does not, by itself, constitute complete customer due diligence under anti-money-laundering laws, Gambling Commission licence conditions, financial-services onboarding requirements, or any other regulated-sector obligation, unless a separate written agreement expressly states otherwise. Operators remain responsible for their own licence conditions and compliance programmes.
22) Liability
To the fullest extent permitted by law, Checkify will not be liable for indirect, incidental, special, consequential or punitive losses, including loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Services or these Terms.
Subject to the next paragraph, Checkify’s total aggregate liability to a Business arising out of or relating to the Services or these Terms in any 12-month period is limited to the total fees paid or payable by that Business to Checkify for the Services in the 12 months immediately before the event giving rise to the claim (or, if no fees were paid in that period, £100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, where such exclusions are not permitted.
Separate written agreements with Business customers may set additional commercial terms, including different liability arrangements. Nothing in this section limits consumer statutory rights that cannot lawfully be excluded or restricted.
23) Business indemnity
If you are a Business, you will indemnify and hold Checkify harmless from reasonable losses, claims and costs arising out of: (a) your misconfiguration of Passes, integrations or enforcement workflows; (b) your misuse of Verification Results; (c) your misrepresentation of what a Proof shows; or (d) your breach of these Terms or applicable law, except to the extent caused by Checkify’s fraud, wilful misconduct or negligence.
24) Consumer rights
If you are a consumer, nothing in these Terms excludes rights that mandatory consumer law gives you.
If a term is found unfair or unenforceable as against a consumer, it will be modified to the minimum extent necessary or severed, and the remaining Terms continue.
25) General provisions
Force majeure. Checkify is not liable for delay or failure caused by events beyond its reasonable control, including outages of third-party infrastructure, utilities, networks, war, terrorism, civil unrest, epidemic, natural disaster, labour dispute, or government action.
Assignment. You may not assign these Terms without Checkify’s prior written consent. Checkify may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets.
Entire agreement. These Terms, together with the Privacy Policy and any applicable order form, Partner Programme Agreement, Data Processing Agreement or product-specific terms, form the entire agreement between you and Checkify about the Services and supersede prior conflicting terms on the same subject, except for fraud.
Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in force.
No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
Third-party rights. Except as expressly stated, these Terms do not create rights enforceable by third parties under the Contracts (Rights of Third Parties) Act 1999.
Notices. Checkify may give notices by email, in-product message, dashboard notice or by posting on checkify.me. Notices to Checkify should be sent to the contact details in the Contact section unless a specific process is stated.
Confidentiality (Business). Each party must keep the other party’s non-public commercial, technical and security information confidential and use it only to perform under these Terms, except for information that is public, independently developed, or required to be disclosed by law.
26) Governing law, courts and language
These Terms are governed by the laws of England and Wales, except where mandatory local law gives you rights that cannot be varied by contract.
Subject to mandatory consumer protections, the courts of England and Wales have exclusive jurisdiction to settle disputes arising out of or in connection with these Terms.
These Terms may be published in multiple languages. If there is a conflict between translations, the English (UK) version prevails, except where mandatory local law requires otherwise.
These Terms are not intended to deprive you of mandatory consumer or local protections that apply in your home jurisdiction.
27) Changes to these Terms
Checkify may update these Terms from time to time.
The “Last updated” date at the top of this page will change when we do. Material changes will be communicated by reasonable means where practical (for example website notice, email or in-product notice).
Continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms, except where acceptance must be obtained in another way under applicable law.
